What is provisional employment? Can I quit before the 90 days if I signed an agreement?

Irma Poiter: There should be some place where you can get free legal advice. I feel that you have a signed contract and they can't change the terms. Be firm abou standing up for your rights now. Later on it'll be harder to get them to keep promises. Now is the best time to negotiate. Use the card that you have given noitce and that this change causes you financial hardship. Dionna Doyel: Depends on whether you got any benefits at the time you signed the contract. If you quit and do find and look for another job just make sure you do not use your present employer as a reference. Also depends what steps would your present employer take to punish you for breaking the signed contract.

Andre Winegar: "Provisional" means THEY can fire you in the first 90 days for no reason at all or if the funding is eliminated or becomes unavailable, etc. Or did you just sign something that said "I understand my employment for the first 90 days s! hall be on a provisional basis."? If so you don't even have a contract you simply have agreed that they can let you go.IF you actually have a contract that guarantees you employment, then you should read the contract carefully and see what it says about "TERMINATION" of the contract.If you quit when you are bound by contract they can theoretically sue you, but the odds against that are extreme -- preschool assistants are not hard to find, and they usually don't have any money that you could win if you sued one. However you would have a problem if a future potential employer found out. So look at the agreement and try to understand how it can be terminated. Giving notice? Mutual agreement? Finally any agreement can be mutually terminated. IF you talk to the principal and are willing to give adequate notice the odds are about 99 to 1 that they will agree to terminate. Or they may assign you to another teacher. No harm in asking and if they won't let you out of it, then you ca! n just walk and see what they do. Bryant Pillitteri: provisional employment means that either one of you can end the employment for any reason within the 90 day period.

Russell Mckinzie: it basically says that i'm on a provisional employement basis. I did not agree to work a certain amount of time. It basically says that i'm going to be paid for 10 months a certain amount and at anytime the employment with the school can be terminated at anytime. thanks everyone for all the answers! You can easily demonstrate damage: notice to your current job, and less compensation than agreed on. Don't take the position without renegotiating. You may litigate against the new employer.
